These Terms of Service ("Terms") govern your access to and use of the One Tap mobile application ("App") and any related services provided by One Tap Text LLC ("One Tap," "we," "us," or "our").
By creating an account, downloading the App, or using any feature of the App — including by checking the consent checkbox presented during account registration — you agree to be bound by these Terms. If you do not agree to these Terms, do not create an account or use the App.
If you are using the App on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms, and "you" refers to that entity.
Our Privacy Policy is incorporated into these Terms by reference and forms part of your agreement with us.
You must be at least 18 years of age to use the App. By agreeing to these Terms, you represent and warrant that:
(a) you are at least 18 years of age;
(b) you have the legal capacity to enter into a binding agreement;
(c) you are not located in, and are not a national or resident of, any country subject to U.S. government embargo or sanctions;
(d) your use of the App does not violate any applicable law or regulation.
To use the App, you must register an account using a valid mobile phone number. You are responsible for:
We reserve the right to disable or terminate any account at any time, with or without notice, for any reason, including but not limited to a violation of these Terms.
One Tap is a mobile application that allows registered users to compose and send group text messages to lists of personal or business contacts. Key features vary by plan and include:
For iOS users, the App provisions a dedicated phone number through our SMS provider (Twilio) from which your messages are sent. This number is linked to your account as described in Section 5.
For Android users, messages are sent from your personal device SIM, and no Twilio number is provisioned.
You agree to use the App only for lawful purposes and in a manner consistent with all applicable local, state, national, and international laws and regulations.
You are solely responsible for all messages you send through the App, the content of those messages, and ensuring that all recipients have consented to receive messages from you.
Safe Sending Rules
During onboarding, you are required to review and acknowledge One Tap's Safe Sending Rules before you may send any messages. These rules are binding and form part of your obligations under these Terms. By acknowledging the Safe Sending Rules, you agree to:
Failure to follow the Safe Sending Rules is a material breach of these Terms and may result in immediate account suspension.
Pre-Send Compliance Acknowledgment
The App presents a compliance disclaimer before your first send on the Free plan and again upon your first send on a paid plan. By proceeding past this disclaimer, you confirm that you understand and accept your legal obligations as a message sender. You may opt to suppress future displays of this disclaimer after your first acknowledgment.
You must not use the App to:
Because the App is used to send SMS messages, you must comply with all laws and regulations governing commercial and non-commercial text messaging. These include, without limitation:
Telephone Consumer Protection Act (TCPA) — The TCPA imposes significant restrictions and penalties on unsolicited text messages sent using automated technology. You are responsible for obtaining all required prior express written consent from recipients before sending marketing or promotional messages. Violations of the TCPA can result in statutory damages of $500–$1,500 per message.
CAN-SPAM Act — To the extent applicable, you must comply with the CAN-SPAM Act, including providing a clear mechanism for recipients to opt out of future messages.
Wireless Carrier Policies — Wireless carriers (AT&T, Verizon, T-Mobile, etc.) have their own guidelines regarding acceptable messaging content and volumes. Carrier filtering of messages that violate these policies is outside our control.
10DLC and A2P Regulations — Application-to-Person (A2P) messaging through Twilio is subject to carrier-mandated 10DLC (10-Digit Long Code) registration requirements. Your use of the App may require campaign registration depending on your messaging volume and use case.
Automatic Opt-Out Introduction Message
To help protect recipients and support your compliance with the TCPA and CAN-SPAM Act, One Tap automatically sends an opt-out introduction message to each recipient the first time you contact them through the App. This message:
You may customize the introductory portion of this message within the App (Account → Opt-Out Message), subject to a character limit. You may not remove, alter, or circumvent the STOP notice that is automatically appended. You are solely responsible for ensuring that your customized intro text is accurate, truthful, and not misleading.
One Tap Text LLC records which recipients have received this opt-out introduction on your behalf. This record is used solely to ensure the message is not sent more than once per sender-recipient pair.
STOP / Opt-Out Processing
When a recipient replies STOP to a message sent through the App, Twilio automatically processes the opt-out at the carrier level and blocks future messages from your sending number to that recipient. One Tap Text LLC does not override or circumvent these opt-out requests. You must not attempt to contact any recipient who has opted out, whether through the App or by any other means.
One Tap Text LLC does not provide legal advice. You should consult a qualified attorney to ensure your messaging practices comply with all applicable laws. We reserve the right to immediately suspend or terminate your account if we receive complaints or evidence of messaging law violations.
For users on iOS, the App assigns you a dedicated phone number provisioned through Twilio. This number is the "From" number shown to your message recipients.
Subscriber number retention: If you are on a paid subscription (Plus, Premium, or Business), your number is maintained for the duration of your subscription plus a 30-day grace period following cancellation.
A la Carte number retention: If you use the A la Carte plan, your number is retained for 60 days from your last send. On day 45, you will receive a notification that your number expires in 15 days. On day 60, the number is released back to Twilio and you will be assigned a new number on your next purchase.
Number release: Released numbers are returned to the Twilio number pool and may be assigned to other users or third parties. One Tap Text LLC is not liable for any messages sent to or from a number after it has been released from your account.
We reserve the right to release or change your number at any time if required by applicable law, carrier policy, or if your account is suspended.
Plans Available
One Tap Text LLC offers the following service tiers: Free, A la Carte, Plus, Premium, and Business. Plan details including recipient limits, monthly send limits, and features are displayed in the App's paywall screen and are subject to change.
Free Plan
The Free plan is available at no charge and includes a limited number of sends. No payment information is required.
A la Carte
A la Carte is a one-time consumable purchase per send, available through the App. Each purchase entitles you to one text send as described at the time of purchase.
Paid Subscriptions
Plus, Premium, and Business plans are offered as monthly or annual subscriptions. Subscriptions are billed through Apple in-app purchases.
Price Changes
We reserve the right to change subscription prices. We will give you reasonable advance notice of any price change by posting a notice in the App. Your continued use of the App after the price change takes effect constitutes your agreement to pay the changed amount.
Refunds
All purchases are made through Apple and are subject to Apple's refund policy. One Tap Text LLC does not issue refunds directly. To request a refund, visit reportaproblem.apple.com.
The App, including its design, code, features, text, graphics, and all other content created by One Tap Text LLC, is owned by One Tap Text LLC and is protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your own personal or business use in accordance with these Terms. This license does not include the right to:
Your Content
You retain ownership of the message content, recipient lists, templates, and groups you create ("Your Content"). By using the App, you grant One Tap Text LLC a limited, non-exclusive license to store, process, and transmit Your Content solely as necessary to provide the App's services to you. This license terminates when you delete the content or close your account.
You represent and warrant that Your Content does not infringe the intellectual property rights or other rights of any third party.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ONE TAP TEXT LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING:
CARRIER MESSAGE FILTERING AND DELIVERY FAILURES ARE OUTSIDE OUR CONTROL. ONE TAP TEXT LLC IS NOT RESPONSIBLE FOR MESSAGES THAT ARE BLOCKED, DELAYED, OR ALTERED BY WIRELESS CARRIERS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ONE TAP TEXT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:
EVEN IF ONE TAP TEXT LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW, ONE TAP TEXT LLC'S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO ONE TAP TEXT LLC IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless One Tap Text LLC and its officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
(a) your violation of these Terms;
(b) your use of the App, including any messages you send through the App;
(c) your violation of any applicable law, including the TCPA, CAN-SPAM Act, or any other messaging regulation;
(d) your violation of any third party's rights, including privacy rights;
(e) any claim that Your Content caused damage to a third party.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Informal Resolution
Before initiating any formal legal proceeding, you agree to first contact us at support@onetaptext.com and attempt to resolve the dispute informally. We will attempt to resolve any dispute within 30 days.
Binding Arbitration
If a dispute cannot be resolved informally, you and One Tap Text LLC agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the App through binding arbitration, rather than in court, except as set forth below. The arbitration shall be conducted by a mutually agreed neutral arbitration provider under its applicable rules.
Class Action Waiver
YOU AND ONE TAP TEXT LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Exceptions
Either party may seek emergency injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending arbitration. Claims related to intellectual property infringement are excluded from mandatory arbitration.
Opt-Out
You may opt out of mandatory arbitration by sending written notice to support@onetaptext.com within 30 days of first accepting these Terms.
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. To the extent a dispute is not subject to arbitration, you consent to the exclusive jurisdiction of the federal and state courts located in the United States.

By Us
We reserve the right to suspend or permanently terminate your account and access to the App at any time, with or without notice, for any reason, including but not limited to:
Upon termination, your right to use the App immediately ceases. Termination does not entitle you to a refund of any prepaid subscription fees. Sections that by their nature should survive termination (including Sections 9, 10, 11, 12, and 13) will survive.
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by displaying a prominent notice in the App at least 7 days before the updated Terms take effect, and we will update the "Effective Date" at the top of these Terms.
Your continued use of the App after the effective date of the updated Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App and close your account before the effective date.
Entire Agreement — These Terms, together with the Privacy Policy, constitute the entire agreement between you and One Tap Text LLC regarding the App and supersede all prior agreements.
Severability — If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid or unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
No Waiver — Our failure to enforce any provision of these Terms shall not be deemed a waiver of our right to enforce that provision in the future.
Assignment — You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
Force Majeure — We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, government action, or internet or telecommunications failures.
